Chandigarh: Two men have been found guilty for having raped their 10-year-old niece in Chandigarh on Tuesday.

The men have been held guilty of rape under Section 376 (2) (f) (i) (n) (raping a minor) of the Indian Penal Code as well as the Protection of Children from Sexual Offences Act (POSCO), and will be sentenced on Thursday.

The victim, who had a baby in August after Supreme Court denied her permission to abort the child because of advanced pregnancy, told police that the older of the two men raped her Christmas of 2016 and April 2017, and the other man — the person who impregnated her — raped her later, although her delivery in August cast doubts on the victim’s stated timeline.

The second uncle was arrested in October after the infant’s DNA matched his.

 The case made national headlines when a local court, and later the Supreme Court, denied the child permission to have the baby aborted because of the danger her advanced pregnancy posed to both the victim and the baby.

The child was 32-weeks pregnant when she approached the Supreme Court.
